On August 19th, I recieved a call at work by a CPS worker Lynn Falvey.asking that I call her back regarding my 2 youngest Gabriel 3 & Justice 4. I called several times not getting an answer, I called the Christian preschool where my sons had attended for 2years & inquired what happened. I was informed that my 4 yr. old had been brought in that morning by dad asking about a bruise my son had on his outer leg. ("A bruise that noone at school, his siblings, even myself had seen the day before when I dropped the kids off to school.") And that CPS had come to the preschool & not only spoke but took pictures of both my youngest sons. The school assured me it was not them that made any calls. & in fact the supervisor of the school "The pastors wife" had tried to assure the CPS worker, My sons had very devoted parents & I imparticular had been very active in my sons activities @ school.
I went straight to the school and when I seen my son, I asked him what happened he told me he had hurt it on the pool ladder @ a birthday party I had taken 3 of my children to that weekend. After I arrived home, The CPS worker called & said she would be by to see me the next day, I left work early & picked my sons up, "It was my 4 yr. olds 5th birthday" We planned previously to go to the park & have lunch. I shortened it to meet the worker.
The CPS worker come to my home with only fingers to point. & before entering was very very rude. She did not ask what happened, she stated she had pictures of this bruise & they were turned over to the sheriffs dept. I repeatedly told her I had no idea how he done this exactly. I had taken the kids to a birthday party over the weekend with approx. 20 other kids to include an astro jump, swimming, biking, and alot of rough housin'.But that I absolutely did not & would not do this to my kids. Lynn "The witch from hell CPS investigator" said my son would need to go to have a "forensic exam" I told her, I would take him without a doubt but, I did not understand, because he told me he fell on a ladder @ a party we had attended. She said the exam would tell us what did make the mark that special Dr.s were trained to find this kind of thing out. Well, of course, I wanted to clear this mess up & find out myself exactly what done this.
I had no idea that I was the one being accused. Until she said, "Your son said you done this. I could not believe this. & I asked that we call him in & talk with him, She said that would not be a good idea. was very rude yet, I agreed to take him to have this exam, because my iggnorance believed someone could prove this was not a mark made by a belt. That it was indeed what he had told me it was.
"I only heard it was a belt after dad came to pick the kids up, he said it looked like a belt mark. one possibly made while my son lay in fetal position"
I took my son to have the exam when CPS called, Upon my arrival, dad was giving information that wasnt with a Dr. who had seen my sons more than 2 times in their lives. I was denied any paperwork being signed unless "Dad" agreed that it was ok. Clearly, I was feeling very much alienated from what was happening. & I could tell from my ex"s actions I had him to blame. Either way, the chadwhick center here in San Diego decided to not do an interview with my son & the child psychologist. I could not understand why & asked. I was told something came up. I left with my son because I had agreed to not only trade weeks with dad, but, to pick them up from school to feed & do homework with them until he could pick them up.
Sept.24th. The witch from CPS called & said my kids were going to stay with their dad & he had been sent to the family courts to seek temporary custody pending the investigation. I told her, she didnt understand, I DONE ABSOLUTELY NOTHING. and she couldnt seperate my kids. "I had previous court battles 1 1/2 yr. ago with this man & his allegations after our seperation was the only ones ever made. I was a very good mom, she could ask anyone that ever seen or knew me & the kids, I asked for a lie detector or something to prove my innocence,I pointed out that she was in our home & that I maintained a stable home & life for these kids" I begged her to not do this to my family, especially my kids. she was seperating them. She apologized & hung up.
After my sons were removed, approx: 3 weeks later "CPS later threatened the school with a $5000.00 fine if they gave me any info on the context of what was said there with my sons"
I heard nothing for days, no returned calls. i called the sheriffs investigators to ask that they start this investigation i wanted to clear this up & get my children back, "they called her, not me." I asked for this to be turned over to a juvenile court matter, even if I went to jail, I would be appointed a lawyer to represent me in this matter. I was desperate. she refused when trying to scare me into thinking there was enough evidence to prosocute.
I went 16 days without seeing or talking to my children, Dad said no, & CPS just directed me to family court.
Sept. 3rd I went to court, the judge"Huntington" would not hear the matter due to an ongoing investigation, I told the judge, "Dad had taken the kids from their school I had not talked to them or seen them in over 2 weeks." & he "the judge" told me to "Quit my whinning" I left very upset & still not knowing what to do, I was told that legally I was not eligible for free legal assistance because CPS was involved. I was a single mom working more than full time to raise 4 kids and no consistent child support.
After this day, I went 62 days without seeing them & only had 5 phone calls allowed per dad. I even sent my sons cards during this time, & "dad" started to send them back because I put their "pet names " on them & not their given names that he felt I should.
(I need to mention I am from WV. I moved back here in 2001 with my ex. 2 weeks later he said we were over, he was seeing a woman I knew & met in our home as his coworker, We went to court when he sued for full custody a month later. The courts said I had to remain here with my kids after he got shared custody in 2002. Unless dad agreed I could leave or their was good reason other than my wanting to just go back home.)
Well, here we are. I have been told I am in denial because I refuse to accept that someone done this to my son, "Meaning me" Therefore, I am to recieve supervised visits 3 hrs a week & attend counseling weekly as well as parenting classes. I have agreed to do anything they ask in order to get my children but, I have been so screwed & do not know what to do, I have no family here.The children 4,5,10.& 13. have not seen or visa versa my mom & family back east in nearly 3 years.
Dad went to court November 19th & was given "sole legal & physical custody without me being notified of a hearing.
I contacted the courts, Cps, counselor everyone. But, noone seemed to care about anything, because they are reading that damned CPS report. They really hang too much on what CPS has said. & As God is my witness, I DID NOT TOUCH ANY OF MY CHILDREN. Therefore, I cannot admitt to something I did not do. I also later found out the reason no child psychologist met with my son was because I took him out for his birthday & I could have tainted evidence with coerceing my kids.
Noone mentioned I had the kids the whole time I was agreeing to cooperate with CPS. Not just that 1 day. I know I felt so set up by my ex & this so called child protective services dept.
I have recently been allowed to see my sons unsupervised for 3 hours on Saturdays.
Justice & Gabriel are constantly asking when they can come back home, But, I do not know what to tell them. If I upset dad he keeps the kids from me. What do I do? Does anyone know where I can go to get some help? My kids & I are being tore apart and noone seems to really care.
(I also want to add, Dad is employed in the federal prison for 17 years or better now & the new step mom is a psychologist therefore, I often feel the odds are against an honset working mother trying to raise her kids with some values & morals in spite of what they are going through)

I am in the process of aquiring a lawyer to regain my children, I have taken a psychological evaluation to prove I am not crazy "That the pool story was not made up in my mind" ugh!
I am not by any means ready to give up fighting for what is right. i still claim to have done nothing at all. & I have nearly completed all of my parenting, counseling & anything thrown my way. with flying colors too. 
No missed appointments, no noted questionable parts on my parenting while I was/have been supervised while I interacted with my children. I have to keep the faith, we all do.
